Property — Personal — Fences. Fences are generally regarded as personal property. 2. Vendor and Purchaser — Contracts — Ambiguity. If a written option agreement for the purchase or sale of lands prepared by a broker were ambiguous, doubts regarding its meaning should be resolved against broker. 3. In action by broker and alleged purchasers against alleged vendor and others for specific performance of an option contract for the purchase of lands, evidence established that alleged purchasers were thinking in terms of a sale including the fences, and that alleged vendor was insisting upon an additional sum to cover value of fences. 4. Vendor and Purchaser — Real Property — Contracts — Meeting of Minds. Where alleged purchasers of land were thinking in terms of a sale including the fences and alleged vendor was insisting upon an additional sum to cover value of fences, there was not a meeting of minds of the contracting parties sufficient to constitute a valid contract of sale. There must be a meeting of the minds of contracting parties.
